Ok everyone did you order the Step 2® Kids Play and Shade Patio Set from JCpenny I, and many other bloggers, posted about last night?

Well you won’t be getting your Patio set :(   People started getting cancellation emails this morning and I just got off the phone with JCPenny and here is What they had to say!

First I talked with a Sales Rep who did verify my order was being canceled even though I have YET to receive an email and already got a confirmation email.

Then I was transferred to Upper Management. What happened was a price error on the Item (though I’m not sure how being it was priced at $15 and now it’s at $90 it’s not like they left out a zero ya know?) and since the item price didn’t match the manufactures the order is not going through EVEN though you got your confirmation email and a Charge to your credit card (which should be refunded if not we have a whole different problem on out hands!)

The Supervisor told me that there were over 10,000 orders placed for the set at $15 and she even ordered one her self at home last night only to come in to work and find out it was being canceled.

Now I asked, well if the price is wrong in store you uphold the lower price so why not online? Well I was told there is a clause from their online site that If the price is wrong basically they can switch it and  don’t have to give you the item. I have not been able to verify this policy because when I click on “Copyright/Legal” on the bottom of the page it just refreshes the homepage.

So in short your won’t be getting your item and they are doing nothing to make their customers happy. I don’t know how many more JCPenny deals you will see from me in the near future.

This has happened in the past with otehr online companies but most ahve tried to make it right with their customers. Well Not JCPenny!

**Update: As of this evening is seems JCPenny has had enough Backlash to do something about it! They are now trying to figure something out with the manufacturer and will let us all know once something is resolved. Currently all orders are on hold.

  1. At Target we had discretion about honoring mis-priced products, too. We were not required to fix them if the difference was over a certain percentage. It’s still a bummer that y’all didn’t get your item, though.

since you are not able to read the “Copyrite/Legal” information I would contact the BBB about this. You are absolutely right about a store upholding the incorrect price. Since you are unable to read this ‘clause’ then I don’t think they can legally uphold it. Just my suggestion, but I would if I ordered the item and I would encourage all who ordered it to do the same.

    Good Luck!

  3. I had this happen to me with JCP back in the summer. they had a sofa listed in their sales paper on sale for $299, but it was for online purchase only. i go to the webiste and they have it listed at $799. i figured maybe the sale hasn’t started yet and i keep checking for a couple days. i call customer service and they basically told me the advertisement was wrong and they could not honor the listed price that was in the paper. so it’s not just the little things they pull the ole bait and switch price routine on it big things too.

Just another reason for me to not like JC Penny. When I got an awesome deal from Toys-r-us for $1.67 Crayola 16 ct crayons, I got 2 packages of Crayola 24 ct markers. They honored the deal – e-mail and charged.

  5. and i was so excited about this deal!!! now i am pissed , off to check to see if i recieved a email ! thanks for the update

  6. Someone should report this to the BBB…

Sad, i really could have used the set. I purchased mine with a gift card, do you think they will refund the money to the card? I still have not received an email from them and do not have the ability to call today. In my understanding of BBB cases, they usually over look things on the part of big stores like JCP and they wont even get a slap on the hand but maybe if enough of us made a claim or got a petition or something going maybe the number of disappointed customers would make them change their mind.

  8. I want to say I’ve heard of this happening before and that people fault it. That it was legitimately advertised for that price and people bought it, therefore a store had to honor the price even if it was an error. I would definitely contact someone. It’s not your fault that they screwed up the pricing.

  10. I filed a complaint with the Better Business Bureau. I would encourage everyone to file as well. The $20 table isn’t the issue. It was a good deal- I ordered it. If I don’t get it, it’s not the end of the world. It is the fact that JCPenny has done this before, and has apparently hasn’t put policies in place to prevent it from happening again. They need to know that they can’t just jerk people around like that.

    Thanks for sharing!!

  12. You are incorrect about it not happening before with JCP. It JUST happened before Christmas, in Nov. or early Dec. with some wooden blocks. Same thing, people bought thousands of orders and then spent thousands of hours all over the internet complaining when it took days/weeks for JCP to cancel the orders. They DID ship some orders, but it was random, and not in the order received, and some people were over-charged in the end.

S— happens, someone made a mistake. I ordered one, and my not get it now. My life will somehow go on :/
